El 13 de octubre de 2025, dos hombres no identificados dispararon contra el defensor de derechos humanos venezolano <strong>Yendri Omar Velásquez Rodríguez</strong> y el analista político colombo-venezolano <strong>Luis Alejandro Peche Arteaga</strong>, cuando ambos salían de un edificio residencial en Bogotá. Hoy, seis meses después, las personas responsables no han sido identificadas ni detenidas. Las organizaciones abajo firmantes expresamos nuestra grave preocupación ante este estado de impunidad y el riesgo persistente que enfrentan las personas defensoras de derechos humanos venezolanas en el exterior.

Yendri Velásquez, quien es fundador del Observatorio Venezolano de Violencias LGBTIQ+ y miembro de Amnistía Internacional Venezuela, fue objeto de <a href="https://spcommreports.ohchr.org/TMResultsBase/DownLoadPublicCommunicationFile?gId=29559" target="_blank" rel="noopener" data-link-id="1534205123">detención arbitraria</a>, desaparición forzada y tortura en Venezuela el 3 de agosto de 2024, cuando se dirigía a Ginebra (Suiza) para participar en la 113ª sesión del Comité de la ONU para la Eliminación de la Discriminación Racial (CERD). Las autoridades venezolanas anularon su pasaporte ese mismo día. Tras huir a Colombia y solicitar refugio en octubre de 2024, el 13 de octubre de 2025 fue víctima de un atentado. Al momento del ataque, Yendri aún esperaba el reconocimiento de su condición de refugiado, a pesar de que había transcurrido más de un año desde su solicitud y de la evidente necesidad de protección internacional en la que se encontraba.

El 10 de diciembre de 2025, la Relatora Especial sobre la situación de las personas defensoras de derechos humanos, la Relatora Especial sobre la libertad de opinión y de expresión y el Experto Independiente sobre orientación sexual e identidad de género enviaron <a href="https://srdefenders.org/venezuela-intento-de-asesinato-contra-el-defensor-de-derechos-humanos-yendri-omar-velasquez-rodriguez-en-colombia-comunicacion-conjunta/" target="_blank" rel="noopener" data-link-id="1534205124">comunicaciones formales</a> a los gobiernos de Colombia y Venezuela solicitando información sobre el caso y la adopción de medidas urgentes para la protección de Yendri Velásquez. A la fecha de publicación de este comunicado, no se han reportado avances en la investigación penal en Colombia.

Las circunstancias del ataque apuntan a un posible caso de represión transnacional. Se necesita una respuesta efectiva por parte de la administración de justicia para identificar a las personas sospechosas de ser las responsables por el ataque. La impunidad ante estos ataques genera un efecto amedrentador en los defensores de derechos humanos venezolanos en el exterior y en la sociedad civil en su conjunto.

<strong>Con base en esta información, las organizaciones firmantes hacemos los siguientes llamados a la acción:</strong>

<strong>Al Gobierno de Colombia:</strong>
<ol>
 	<li>Avanzar de manera urgente, exhaustiva e imparcial en la investigación del ataque del 13 de octubre de 2025, incluyendo la hipótesis de una posible participación de actores estatales venezolanos, y garantizar la rendición de cuentas de los responsables.</li>
 	<li>Mantener y robustecer las medidas de protección para Yendri Velásquez y Luis Peche, así como adoptarlas para otros defensores de derechos humanos venezolanos en riesgo.</li>
 	<li>Dar cumplimiento a la sentencia SU-543/23 de la Corte Constitucional, que ordena implementar una política pública para descongestionar el trámite de las solicitudes de refugio.</li>
 	<li>Implementar protocolos específicos de protección para personas defensoras de derechos humanos solicitantes de asilo que enfrentan riesgos de represión transnacional.</li>
 	<li>Fortalecer las capacidades institucionales para prevenir posibles actos de represión transnacional.</li>
</ol>
<strong>A las autoridades en Venezuela:</strong>
<ol>
 	<li>Cooperar con las autoridades colombianas en la investigación del ataque, incluyendo la indagación sobre la posible participación de funcionarios venezolanos u otros actores asociados.</li>
 	<li>Responder formalmente a las comunicaciones enviadas el 10 de diciembre de 2025 por los Procedimientos Especiales de la ONU.</li>

La represión transnacional debe ser reconocida como una amenaza para las personas defensoras de derechos humanos y se deben adoptar medidas que garanticen de forma efectiva su protección en los países de acogida.

Las organizaciones firmantes continuaremos monitoreando la situación y demandando justicia para los activistas Yendri Velásquez y Luis Peche. La impunidad en estos ataques constituye una señal de tolerancia, que pone en peligro la vida de todas las personas defensoras venezolanas en el exterior.]]></description>

		<title>Indonesia: Hold perpetrators of acid attacks against human rights defender Andrie Yunus accountable</title>

					<description><![CDATA[The Observatory has been informed about recent developments concerning the attack against Mr <strong>Andrie Yunus</strong>, human rights defender and Deputy Coordinator of the Commission for the Disappeared and Victims of Violence (KontraS), in which he sustained serious injuries.

On 12 March 2026 at 11:37 pm, two unidentified individuals attacked Andrie Yunus by throwing acid at him while he was riding his motorcycle on Jalan Salemba I–Talang Street in Jakarta, after he had left the office of the Indonesian Legal Aid Foundation (YLBHI), where he had recorded a podcast on the topic of “Remilitarisation and Judicial Review in Indonesia.” The podcast was referring to the revised Military Law and broader concerns regarding militarisation and democratic oversight in Indonesia. The perpetrators fled on a motorbike immediately after the attack.

This acid attack struck the right side of his body - particularly his eye, face, neck, and chest - and both hands. Despite his injuries Mr Yunus managed to leave the scene and was taken by his housemates to Dr. Cipto Mangunkusumo Hospital (RSCM) in Jakarta, where he received emergency treatment.

Medical examinations indicated that Mr Yunus sustained burns covering approximately 20% of his body, while confirming severe chemical trauma to the right eye, including 40% corneal damage due to acid penetration. Mr Yunus has undergone multiple medical procedures, including the removal of dead skin tissue and surgery on his eye. At the time of publication of this Urgent Appeal, Mr Yunus remained in intensive care at Dr. Cipto Mangunkusumo Hospital (RSCM).

In the days preceding the attack, between 9 and 11 March 2026, Mr Yunus received repeated calls from several unknown phone numbers, to which he did not respond. In addition, Mr Yunus had previously experienced acts of intimidation, particularly following the “Fairmont Protest Action” in Jakarta in March 2025, when he and other members of civil society protested against the closed-door deliberations on revisions to Indonesia’s Military Law.

Early on 12 March, Mr Yunus attended a meeting at the office of the Center of Economic and Law Studies (CELIOS) to discuss the investigative report of the Fact-Finding Commission on the August 2025 protests, in which Mr Yunus had been actively involved. He then went to the YLBHI office, where he remained until approximately 11:00 pm. CCTV footage later showed that individuals suspected of being involved in the attack had already begun monitoring Mr Yunus while he was still at the YLBHI office, from approximately 8:40 pm. After the attack, police appeared at the RSCM to collect testimonies from Mr Yunus and his colleagues and then proceeded to the site of the incident.

On 13 March 2026, a police report was filed and investigators from the Central Jakarta Metro Police formally upgraded the case from a preliminary inquiry to a criminal investigation and initiated the investigation, including the collection and analysis of CCTV footage and the questioning of witnesses.

On 18 March 2026, military authorities announced they had arrested four members of the Strategic Intelligence Agency (BAIS) of the Indonesian National Armed Forces (TNI) and placed them in military custody. However, at the time of publication of this urgent appeal, it remained unclear whether all those responsible, including additional suspects identified by the police and those potentially involved in planning, coordinating, or ordering the attack, had been charged with any offenses.

On 18 March 2026, Indonesian law enforcement authorities publicly presented initial findings of the investigation, indicating that between two and four perpetrators were involved.

On 25 March 2026, BAIS head Lt Gen Yudi Abrimantyo resigned, describing this as a form of institutional accountability. However, Mr. Yunus’ representatives stressed that such a resignation cannot substitute for an effective and independent investigation into the entire chain of responsibility.

According to the findings of an <a href="https://en.tempo.co/read/2095537/taud-alleges-16-people-involved-in-andrie-yunus-acid-attack" target="_blank" rel="noopener" data-link-id="1532211651">independent investigation</a> conducted by the Advocacy Team for Democracy (TAUD), a coalition of civil society organisations and human rights lawyers in Indonesia, which were released on 30 March 2026, this acid attack against Mr Yunus should not be understood as an isolated act of only two perpetrators, as it was initially thought by the authorities, but rather as a planned and organised operation that may have involved up to 16 individuals. They include the two assailants who carried out the acid attack, as well as surveillance operatives, trackers, site scouts, and a field coordinator. In light of these elements, TAUD formally requested that the attack be investigated as attempted premeditated murder under Article 459 in conjunction with Articles 17 and 20 of the Indonesian Criminal Code.

The Observatory notes with serious concern that the acid attack against Mr Yunus may amount to an attempted premeditated murder carried out in reprisal for his legitimate work as a human rights defender.

The Observatory is also deeply worried by the growing indications that the attack may have involved multiple actors and possible links to state security structures, as well as by the risk of impunity if the case is not thoroughly and independently investigated.

The Observatory expresses its concerns regarding the fact that some of the identified suspects may be linked to the BAIS and calls for an immediate and full investigation to track all those responsible for the attack.

The Observatory recalls that this attack is part of an ongoing <a href="https://www.fidh.org/en/issues/human-rights-defenders/indonesia-ongoing-acts-of-harassment-and-intimidation-against-kontras" target="_blank" rel="noopener" data-link-id="1532211655">pattern of intimidation and harassment</a> against KontraS and its members, including surveillance of offices, repeated threatening phone calls, attempted break-ins, the presence of military vehicles around its premises and <a href="https://www.fidh.org/en/issues/human-rights-defenders/indonesia-judicial-harassment-against-fatia-maulidiyanti-and-haris" target="_blank" rel="noopener" data-link-id="1532211658">judicial harassment</a>.

The Observatory further recalls that Indonesia currently holds the Presidency of the United Nations Human Rights Council and must therefore act in an exemplary manner in complying with its international human rights obligations, including under the International Covenant on Civil and Political Rights (ICCPR), to which it is a state party. The Indonesian government must ensure the protection of human rights defenders, as enshrined in Articles 28C and 28G of the 1945 Indonesian Constitution, and Articles 100 and 101 of Law No. 39 of 1999 on Human Rights.

The Observatory condemns the assault on Andrie Yunus, which seems to be only aimed at silencing him for his legitimate work as a human rights defender, and urges the Indonesian authorities to carry out a prompt, thorough and independent investigation to bring all those responsible to justice.]]></description>

The perpetrators deliberately doused Yunus with a hazardous chemical into vital organs, including on his face and respiratory tract, indicating that the attack was intended to take the victim’s life. Therefore, we believe that this incident must be treated as attempted murder and must be investigated thoroughly and transparently by law enforcement authorities.

This attack cannot be separated from the context of the victim’s work as a human rights defender who has consistently exposed abuses of power, human rights violations, and the shrinking civic space in Indonesia. In the days leading up to the incident, the victim had also continuously received various forms of intimidation, including suspicious calls from unknown numbers. This practice indicates systematic efforts to spread fear among those actively engaged in advocacy and the defence of human rights.

Furthermore, Andrie Yunus is one of the<strong> members of the Fact-Finding Commission (KPF)</strong> who, over the past five months, has conducted an independent investigation into the Indonesian Nationwide protests and unrest in August 2025.

Through extensive investigations, the KPF report found that the security forces had used force disproportionately, conducted mass arrests, committed alleged torture, and the large-scale criminalization against activists and civilians. The events of August 2025 also resulted in about 13 deaths, marking one of the largest waves of repression against civil society since the Indonesian Reformation era in 1998.

Andrie Yunus has <strong>protested against the considered non-transparent</strong> <strong>process of discussing revisions to the Indonesian Military Law</strong>. On 15 March 2025, together with other members of the civil society coalition, he forced his way into the parliamentary meeting at the Fairmont Hotel in Jakarta to interrupt the closed-door discussion of revisions to the military law between the government and the House of Representatives of the Republic of Indonesia. This action was carried out in protest against the untransparent nature of the deliberation process, which excluded public participation and risked reviving the military’s dual-function doctrine of the pre-1998 dictatorship.

This assault must be seen as part of a pattern of intimidation against human rights defenders and a systematic effort to silence those who dare to reveal the truth, challenge impunity, criticize those in power, and fight for justice. If a human rights defender can be brutally assaulted in a public space in the nation’s capital, this demonstrates how fragile state protection is for citizens who fight for justice and how narrow the safe space for human rights advocacy has become in Indonesia.

It is also deeply regrettable that human rights defenders in Indonesia are facing attacks and intimidation at the time when Indonesia is the current President of the United Nations Human Rights Council. This contradiction shows the failure of the Government of Indonesia to comply with its international obligations to protect human rights defenders.

Thus, we urge:

 	<li>The Indonesian Police to carry out an immediate, thorough and impartial investigation into the attack, identify all those responsible, and bring the latter to justice in accordance with international standards and existing domestic regulations;</li>
 	<li>The Indonesian Attorney General to immediately prosecute those who carried out the attack and those who commissioned it based on the thorough and impartial investigation result;</li>
 	<li>The Indonesian Witness and Victims Protection Agency (LPSK) to guarantee and ensure the safety and protection of Andrie Yunus and his family, especially throughout his recovery;</li>
 	<li>The National Commission on Human Rights (Komnas HAM) to ensure the safety and protection of Andrie Yunus, his family, and Witnesses in relation to his work as a human rights defender, as stated in the Commission Regulation Number 5 of 2015 on Procedure of Protection for Human Rights Defenders and Norms and Regulation Standard of the Commission Number 4 of 2021 on Protection for Human Rights Defenders;</li>
 	<li>The Government of Indonesia to guarantee the safety and protection of Andrie Yunus and his family in relation to his work as an advocate, as stated in Law Number 18 of 2003 on Advocates; and</li>
 	<li>The Government of Indonesia to protect all human rights defenders, as guaranteed by Article 28C (2) of the 1945 Constitution, Article 100 of Law Number 39 of 1999 on Human Rights, and by the 1998 United Nations Declaration on Human Rights Defenders.</li>

The undersigned organizations and individuals also call for international solidarity, to continuously monitor this case as well as the recent disturbing climate of criminalization and threats towards focal individuals in Indonesia, to urge the Indonesian authorities to guarantee their safety and civic space, and to publicly oppose attacks and terrorism against human rights defenders, as terror against one human rights defender is terror against an entire society.

We will continue to monitor this case until the perpetrators and those responsible are brought to justice, as there cannot be any space left for terror against human rights defenders in a democratic country.

At approximately 9:00 a.m. on 02 March 2026, two armed men who were riding a motorcycle, opened fire on <strong>Yanar Mohammed</strong> inside her residence in northern Baghdad. Seriously injured, Yanar Mohammed was transferred to hospital, where she succumbed to her wounds.

At the time of publication of this statement, no one has claimed responsibility for the attack, and the identities of those responsible, as well as the motives behind the killing, remain unknown. It is essential that an independent and thorough investigation should be established to examine that assassination which is linked to her human rights activism, as reported by reliable local sources.

Yanar Mohammed was an internationally-recognised human rights defender. She co-founded OWFI in 2003, following the fall of Saddam Hussein’s regime, with the aim of promoting women’s rights and combating gender-based violence. For over two decades, she worked to protect women facing domestic abuse, forced marriage, trafficking, and so-called “honour” killings. Under her leadership, OWFI established a network of safe houses across numerous Iraqi cities, providing protection and support to hundreds of women at risk.

Yanar Mohammed publicly defended gender equality, and universal human rights. She consistently denounced the use of sexual violence as a weapon of war, the impunity of armed groups, and systemic discrimination against women and minorities. In 2016, she was awarded the Norwegian <a href="https://www.rafto.no/en/news/the-rafto-foundation-in-deep-mourning-following-the-assassination-of-yanar-mohammed" rel="external">Rafto Prize for Human Rights</a> in recognition of her courageous commitment.

She carried out her activism in a highly-dangerous environment. She had been subjected to <a href="https://libcom.org/article/statement-assassination-our-dear-comrade-yanar-mohammed-0" rel="external">repeated death threats</a> and, at times, was forced to restrict her movements. In 2020, she and OWFI were <a href="https://www.gc4hr.org/eighth-periodic-report-on-violations-during-popular-demonstrations-part-2/" rel="external">targeted by judicial proceedings</a> initiated by the General Secretariat of the Council of Ministers, notably in relation to the organisation’s operation of shelters for women fleeing violence. These proceedings, widely considered to lack legal basis, took place in a broader context of judicial pressure against organisations defending women’s rights.

In her recent activities, Yanar Mohammed focused on following up cases of Yazidi women and other survivors of abuses linked to ISIS elements in Iraq, calling for investigations into these violations and accountability for those responsible.

The assassination of Yanar Mohammed occurs within a <a href="https://www.frontlinedefenders.org/sites/default/files/fld_upr_iraq_2024.pdf" rel="external">broader pattern of attacks</a>, abductions, and <a href="https://www.gc4hr.org/iraq-joint-submission-to-un-universal-periodic-review-48th-session/" rel="external">killings targeting activists, journalists, and human rights defenders</a> in Iraq in recent years. This context reflects persistent shortcomings in the protection of human rights defenders and in combating impunity for such crimes.

Our organisations recall that Iraq, as a State Party to the International Covenant on Civil and Political Rights (ICCPR), has an obligation to protect the right to life and to take all necessary measures to prevent, investigate, and punish violations of this right (Article 6). Also, in accordance with the United Nations Declaration on Human Rights Defenders, authorities have a duty to ensure a safe and enabling environment for those engaged in the promotion and protection of human rights.

Our organisations call on the Iraqi authorities to immediately conduct an independent, impartial and transparent investigation to identify the perpetrators and those who may have ordered this assassination, and to bring them to justice in accordance with international standards. The authorities must also adopt effective protection measures for human rights defenders, in particular those working on women’s rights, who face heightened risks.

		<title>Perú: Ataques contra el defensor y sindicalista Carlos Enrique Carrasco</title>

					<description><![CDATA[El Observatorio ha recibido información sobre un ataque contra el defensor de derechos humanos laborales, el Sr. <strong>Carlos Enrique Carrasco</strong>, Secretario General del Sindicato de Obreros del Puerto de la Municipalidad de Supe Puerto (SITRAMOB-SUPE), en el departamento de Lima, Perú.

El sábado 25 de octubre de 2025, aproximadamente a las 21:25 horas, el Sr. Carlos Enrique Carrasco se encontraba en su domicilio junto con su esposa y sus dos hijos, ambos menores de edad, regresando a su casa después de realizar algunas compras, cuando personas desconocidas dispararon a la propiedad en cuatro ocasiones.

Este ataque se dió después de un paro de 24 horas celebrado el 6 de octubre de 2025 y tras una serie de reuniones entre el SITRAMOB-SUPE y la Municipalidad Distrital del Supe Puerto para llegar a un acuerdo tras el incumplimiento, por parte de la Municipalidad, de derechos previstos en el pacto colectivo de trabajo.

El viernes 24 de octubre de 2025, horas antes del ataque, el Sr. Carlos Enrique Carrasco participó en la última junta entre el sindicato y la Municipalidad. Según la información recibida, durante las reuniones anteriores, las autoridades patronales se mostraron hostiles en contra de los dirigentes sindicales, lo que reforzaría la hipótesis de que el ataque sería una represalia por la actividad sindical y de defensa de derechos laborales del Sr. Carlos Enrique Carrasco.

El SITRAMOB-SUPE está denunciando el incumplimiento de los actos y convenios colectivos durante la nueva gestión de la Municipalidad Distrital del Supe Puerto, la falta de equipo de protección personal, la ausencia de personal responsable de la seguridad y de personas responsables de dar entrenamientos de seguridad al personal. Por ello, los sindicalistas señalan que las condiciones laborales para los trabajadores de la municipalidad son sumamente riesgosas y violan los estándares legales. Más aún, el Sindicato entró en paro a inicios del mes de octubre de 2025 para protestar la falta de pagos, el estancamiento de los salarios de los trabajadores desde hace tres años, y su disparidad frente a los ingresos de los funcionarios de la municipalidad.

El Observatorio recuerda que los derechos sindicales y laborales incluyen una serie de libertades protegidas por diversos instrumentos del derecho internacional de los derechos humanos. Especialmente, la libertad de asociación, protegida por el Artículo 22 del Pacto Internacional de Derechos Civiles y Políticos, el Artículo 5 del Pacto Internacional de Derechos Económicos, Sociales y Culturales, y el Artículo 16 de la Convención Americana sobre Derechos Humanos. Más aún, los Convenios N°87 y N°98 de la Organización Internacional del Trabajo protegen la libertad para establecer sindicatos y el derecho a la huelga, así como el derecho a la negociación colectiva, respectivamente.

El Observatorio expresa su profunda preocupación por el ataque sufrido por el defensor Carlos Enrique Carrasco, su esposa, y su familia, el cual no sólo afecta directamente su vida e integridad física y psicológica, sino que impacta negativamente en el ejercicio de la defensa de los derechos laborales que realiza el SITRAMOB-SUPE.

Por esto, el Observatorio solicita a las autoridades peruanas que garanticen la protección de Carlos Enrique Carrasco, su esposa, su familia y todas las personas integrantes del SITRAMOB-SUPE, incluso a través de medidas de protección del Mecanismo Intersectorial para la Protección de Personas Defensoras de Derechos Humanos.

El Observatorio insta también a la Fiscalía Especializada en Derechos Humanos e Interculturalidad a emprender una investigación inmediata, independiente, exhaustiva e imparcial sobre el ataque en el domicilio del defensor; a identificar plenamente a los responsables materiales e intelectuales y presentarlos ante un tribunal competente, independiente, justo e imparcial, y reciban las sanciones penales y de otra naturaleza jurídica previstas en la normativa interna.]]></description>

El sábado 25 de octubre de 2025, aproximadamente a las 21:25 horas, el Sr. Carlos Enrique Carrasco se encontraba en su domicilio junto con su esposa y sus dos hijos, ambos menores de edad, regresando a su casa después de realizar algunas compras, cuando personas desconocidas dispararon a la propiedad en cuatro ocasiones.

Este ataque se dió después de un paro de 24 horas celebrado el 6 de octubre de 2025 y tras una serie de reuniones entre el SITRAMOB-SUPE y la Municipalidad Distrital del Supe Puerto para llegar a un acuerdo tras el incumplimiento, por parte de la Municipalidad, de derechos previstos en el pacto colectivo de trabajo.

El viernes 24 de octubre de 2025, horas antes del ataque, el Sr. Carlos Enrique Carrasco participó en la última junta entre el sindicato y la Municipalidad. Según la información recibida, durante las reuniones anteriores, las autoridades patronales se mostraron hostiles en contra de los dirigentes sindicales, lo que reforzaría la hipótesis de que el ataque sería una represalia por la actividad sindical y de defensa de derechos laborales del Sr. Carlos Enrique Carrasco.

El SITRAMOB-SUPE está denunciando el incumplimiento de los actos y convenios colectivos durante la nueva gestión de la Municipalidad Distrital del Supe Puerto, la falta de equipo de protección personal, la ausencia de personal responsable de la seguridad y de personas responsables de dar entrenamientos de seguridad al personal. Por ello, los sindicalistas señalan que las condiciones laborales para los trabajadores de la municipalidad son sumamente riesgosas y violan los estándares legales. Más aún, el Sindicato entró en paro a inicios del mes de octubre de 2025 para protestar la falta de pagos, el estancamiento de los salarios de los trabajadores desde hace tres años, y su disparidad frente a los ingresos de los funcionarios de la municipalidad.

El Observatorio recuerda que los derechos sindicales y laborales incluyen una serie de libertades protegidas por diversos instrumentos del derecho internacional de los derechos humanos. Especialmente, la libertad de asociación, protegida por el Artículo 22 del Pacto Internacional de Derechos Civiles y Políticos, el Artículo 5 del Pacto Internacional de Derechos Económicos, Sociales y Culturales, y el Artículo 16 de la Convención Americana sobre Derechos Humanos. Más aún, los Convenios N°87 y N°98 de la Organización Internacional del Trabajo protegen la libertad para establecer sindicatos y el derecho a la huelga, así como el derecho a la negociación colectiva, respectivamente.

El Observatorio expresa su profunda preocupación por el ataque sufrido por el defensor Carlos Enrique Carrasco, su esposa, y su familia, el cual no sólo afecta directamente su vida e integridad física y psicológica, sino que impacta negativamente en el ejercicio de la defensa de los derechos laborales que realiza el SITRAMOB-SUPE.

Por esto, el Observatorio solicita a las autoridades peruanas que garanticen la protección de Carlos Enrique Carrasco, su esposa, su familia y todas las personas integrantes del SITRAMOB-SUPE, incluso a través de medidas de protección del Mecanismo Intersectorial para la Protección de Personas Defensoras de Derechos Humanos.

El Observatorio insta también a la Fiscalía Especializada en Derechos Humanos e Interculturalidad a emprender una investigación inmediata, independiente, exhaustiva e imparcial sobre el ataque en el domicilio del defensor; a identificar plenamente a los responsables materiales e intelectuales y presentarlos ante un tribunal competente, independiente, justo e imparcial, y reciban las sanciones penales y de otra naturaleza jurídica previstas en la normativa interna.]]></content:encoded>

Desde hace años la OFRANEH, la Red Nacional de Defensoras en Honduras (integrante de la IM-Defensoras) y distintas organizaciones nacionales e internacionales han denunciado los graves impactos de la grabación del reality show “Supervivientes” sobre las comunidades garífunas del archipiélago de Cayos Cochinos.

Estas empresas recibieron el permiso para trabajar en este territorio del Estado de Honduras y la Fundación Cayos Cochinos, entidad a la que le fue otorgada la administración de este territorio y que tiene el mismo presidente que la Sociedad de Inversiones Ecológicas (SIEC), dueña de los lugares donde se graba el concurso.[1]

La grabación de dicho programa ha generado daños ambientales, restricciones a los y las habitantes para la realización de sus actividades de subsistencia y provocando conflictos entre las comunidades y hechos de violencia, racismo e intimidación contra quienes han protestado por la imposición de este proyecto. Ejemplo de ello es el vertido de basura al mar o la prohibición a la población de acceder a la playa y pescar, para poder simular que el programa se desarrolla en una isla desierta. De esta situación han dado cuenta diferentes medios del Estado español.[2]

Respecto a la represión contra pobladores y pobladoras que se oponen a este proyecto el hecho más reciente fue el pasado 4 de septiembre del 2025 cuando <a href="https://click.mailerlite.com/link/c/YT0yODQ3MjMxNTAyNjYyNTA1NTM4JmM9dDlnNiZiPTE0ODI1ODQ1MjcmZD1nM3oxajF0.ax_N6PTbXWjNk4d1qRPidfNvcGXovGsvzauS7N8hbuM" target="_blank" rel="noopener" data-link-id="1482584527">fuerzas policiales y elementos de la Fuerza Naval de Honduras llevaron a cabo acciones violentas e intimidatorias en contra de quienes realizaban un plantón pacífico en Cayos Cochinos para denunciar que la filmación del programa también está afectando el proceso de desove de la tortuga de carey</a>, que se realiza en el mes de septiembre, y puede poner en riesgo todo el ciclo de reproducción y vida de una especie en peligro de extinción.

A pesar de que la OFRANEH ha puesto en conocimiento a la productora del programa de estas afectaciones sociales y ambientales y de que le solicitaron suspender la grabación, cambiarla de fecha y de lugar, el programa siguió grabándose sin importar el daño que está provocando.

Ante la falta de respuesta del Estado hondureño frente a las violaciones de derechos de la población garífuna y al igual que en los casos de las comunidades garífunas de San Juan, Punta Piedra y Triunfo de la Cruz, donde el Estado hondureño fue condenado por vulnerar los derechos del pueblo garífuna– <a href="https://click.mailerlite.com/link/c/YT0yODQ3MjMxNTAyNjYyNTA1NTM4JmM9dDlnNiZiPTE0ODI1ODQ1MjgmZD1pN2k1ZTZw.ouYYL1IG4VLnKszHT6u2TUetVR4kTa2WIoOtyqGE4FQ" target="_blank" rel="noopener" data-link-id="1482584528">el caso de Cayos Cochinos también ha sido llevado por la OFRANEH ante la Corte IDH</a>, desarrollándose las audiencias correspondientes el pasado mes de mayo.

		<title>République démocratique du Congo : menaces de mort et des attaques à l’encontre du journaliste Pacifique Muliri</title>

					<description><![CDATA[L’Observatoire a été informé des menaces de mort et des attaques à l’encontre de M. <strong>Pacifique Muliri</strong>, journaliste à l’Agence congolaise de presse (ACP) et collaborateur indépendant d’Africa Mining Intelligence, organe d’information sur le secteur minier basé en France.

Le 4 juillet 2025, la maison de M. Muliri à Bukavu, dans la province du Sud-Kivu, a été attaquée par des soldats du Mouvement du 23 Mars (M23)/Alliance du Fleuve Congo (AFC), et le 6 juillet 2025, son domicile a été cambriolé par des hommes non identifiés qui ont pris son ordinateur portable, son appareil photo, son enregistreur et son carnet de notes. M. Muliri était présent à son domicile lors des deux attaques, mais a réussi à s’échapper avant que les hommes n’arrivent, alerté par des voisins. Suite à ces épisodes, M. Muliri a pris la fuite et est entré en clandestinité.

Du 1er au 3 juillet 2025, M. Muliri avait effectué un reportage à la mine de Lomera, dans le territoire de Kabare, dans la province du Sud-Kivu, où il enquêtait sur des allégations d’exploitation illégale d’or impliquant une collaboration entre des groupes rebelles de la région et les autorités gouvernementales de Kinshasa.

Depuis la clandestinité, M. Muliri a reçu des appels téléphoniques et des menaces de mort de la part de numéros inconnus par le biais de textos. Dans des messages supplémentaires envoyés le 19 septembre 2025, les expéditeurs ont menacé de trouver et de tuer M. Muliri s’il n’abandonnait pas son travail.

Selon des sources, depuis juillet, au moins trois personnes qui ont aidé M. Muliri dans son enquête sur la mine de Lomera ont été tuées à Bukavu dans des circonstances encore inexpliquées. Il s’agit de M. Fiston Wilondja, un ancien journaliste devenu photographe, et de deux autres habitants de Bukavu.

L’Observatoire rappelle que ces actes se produisent dans un contexte <a href="https://www.fidh.org/IMG/pdf/20240823_fidh_rapport-obs-rdc_fr_web-2.pdf" target="_blank" rel="noopener" data-link-id="1480609967">d’attaques systématiques contre les défenseur·es des droits humains et de restriction manifeste de l’espace civique en RDC</a>, en particulier depuis l’accession à un second mandat du président Félix Tshisekedi en décembre 2023. La situation des <a href="https://www.omct.org/fr/ressources/declarations/lomct-exhorte-le-gouvernement-congolais-à-mettre-fin-aux-intimidations-visant-les-journalistes-et-les-défenseur-es-des-droits-humains" target="_blank" rel="noopener" data-link-id="1480609968">journalistes et défenseur·es des droits humains</a> s’est par ailleurs gravement détériorée depuis janvier 2025, avec l’intensification du conflit à l’est du pays entre le M23, soutenu par l’armée rwandaise selon les Nations unies, et l’armée régulière de la RDC (FARDC) et ses alliés. Les groupes armés rebelles et le gouvernement congolais réduisent au silence les voix qui dénoncent les abus et violations des droits humains dans les territoires occupés par le M23 comme dans le reste du pays.

L’Observatoire exprime sa vive inquiétude face aux attaques et menaces de mort à l’encontre de M. Pacifique Muliri, qui ne semblent viser qu’à restreindre sa liberté d’expression et l’exercice légitime de documentation des violations des droits humains.

L’Observatoire appelle les autorités congolaises à prendre toutes les mesures nécessaires afin d’assurer la sécurité physique et le bien-être psychologique de M. Pacifique Muliri. L’Observatoire appelle également les autorités congolaises à mener une enquête indépendante, rigoureuse, impartiale et transparente afin d’identifier les responsables de ces attaques et menaces de mort, et de les traduire devant un tribunal indépendant, compétent et impartial.

L’Observatoire rappelle au M23/AFC ses obligations au regard du droit international humanitaire et des droits humains, et l’enjoint à faire cesser immédiatement toute menace ou intimidation visant M. 										<content:encoded><![CDATA[L’Observatoire a été informé des menaces de mort et des attaques à l’encontre de M. <strong>Pacifique Muliri</strong>, journaliste à l’Agence congolaise de presse (ACP) et collaborateur indépendant d’Africa Mining Intelligence, organe d’information sur le secteur minier basé en France.

Le 4 juillet 2025, la maison de M. Muliri à Bukavu, dans la province du Sud-Kivu, a été attaquée par des soldats du Mouvement du 23 Mars (M23)/Alliance du Fleuve Congo (AFC), et le 6 juillet 2025, son domicile a été cambriolé par des hommes non identifiés qui ont pris son ordinateur portable, son appareil photo, son enregistreur et son carnet de notes. M. Muliri était présent à son domicile lors des deux attaques, mais a réussi à s’échapper avant que les hommes n’arrivent, alerté par des voisins. Suite à ces épisodes, M. Muliri a pris la fuite et est entré en clandestinité.

Du 1er au 3 juillet 2025, M. Muliri avait effectué un reportage à la mine de Lomera, dans le territoire de Kabare, dans la province du Sud-Kivu, où il enquêtait sur des allégations d’exploitation illégale d’or impliquant une collaboration entre des groupes rebelles de la région et les autorités gouvernementales de Kinshasa.

Depuis la clandestinité, M. Muliri a reçu des appels téléphoniques et des menaces de mort de la part de numéros inconnus par le biais de textos. Dans des messages supplémentaires envoyés le 19 septembre 2025, les expéditeurs ont menacé de trouver et de tuer M. Muliri s’il n’abandonnait pas son travail.

Selon des sources, depuis juillet, au moins trois personnes qui ont aidé M. Muliri dans son enquête sur la mine de Lomera ont été tuées à Bukavu dans des circonstances encore inexpliquées. Il s’agit de M. Fiston Wilondja, un ancien journaliste devenu photographe, et de deux autres habitants de Bukavu.

L’Observatoire rappelle que ces actes se produisent dans un contexte <a href="https://www.fidh.org/IMG/pdf/20240823_fidh_rapport-obs-rdc_fr_web-2.pdf" target="_blank" rel="noopener" data-link-id="1480609967">d’attaques systématiques contre les défenseur·es des droits humains et de restriction manifeste de l’espace civique en RDC</a>, en particulier depuis l’accession à un second mandat du président Félix Tshisekedi en décembre 2023. La situation des <a href="https://www.omct.org/fr/ressources/declarations/lomct-exhorte-le-gouvernement-congolais-à-mettre-fin-aux-intimidations-visant-les-journalistes-et-les-défenseur-es-des-droits-humains" target="_blank" rel="noopener" data-link-id="1480609968">journalistes et défenseur·es des droits humains</a> s’est par ailleurs gravement détériorée depuis janvier 2025, avec l’intensification du conflit à l’est du pays entre le M23, soutenu par l’armée rwandaise selon les Nations unies, et l’armée régulière de la RDC (FARDC) et ses alliés. Les groupes armés rebelles et le gouvernement congolais réduisent au silence les voix qui dénoncent les abus et violations des droits humains dans les territoires occupés par le M23 comme dans le reste du pays.

L’Observatoire exprime sa vive inquiétude face aux attaques et menaces de mort à l’encontre de M. Pacifique Muliri, qui ne semblent viser qu’à restreindre sa liberté d’expression et l’exercice légitime de documentation des violations des droits humains.

L’Observatoire appelle les autorités congolaises à prendre toutes les mesures nécessaires afin d’assurer la sécurité physique et le bien-être psychologique de M. Pacifique Muliri. L’Observatoire appelle également les autorités congolaises à mener une enquête indépendante, rigoureuse, impartiale et transparente afin d’identifier les responsables de ces attaques et menaces de mort, et de les traduire devant un tribunal indépendant, compétent et impartial.

L’Observatoire rappelle au M23/AFC ses obligations au regard du droit international humanitaire et des droits humains, et l’enjoint à faire cesser immédiatement toute menace ou intimidation visant M. 		<title>Chile: Detención arbitraria de Juan Pichún, líder indígena Mapuche, después de pronunciamiento ante el Consejo de Derechos Humanos de NN.UU.</title>

Juan Pichún es uno de los hijos del lonko <strong>Pascual Pichún</strong>, condenado injustamente bajo la ley antiterrorista y luego <a href="https://www.fidh.org/en/region/americas/chile/the-inter-american-court-of-human-rights-condemns-the-state-of-chile">absuelto tras una histórica sentencia de la Corte Interamericana de Derechos Humanos.</a>

El 26 de junio de 2025, Juan Pichún regresaba a su hogar después de celebrar la ceremonia We tripantu – la celebración del año nuevo mapuche, que se realiza en el solsticio de invierno austral – en la comunidad de Pantano, cercana a su comunidad de Temulemu, cuando agentes de la Policía de Investigación (PDI) lo detuvieron, en frente de su familia, incluyendo su hijo y sobrina, ambos menores de edad. Los policías actuaron en virtud de una orden de detención emitida por el Juzgado de Garantía de Purén. Durante el acto de detención, policías intentaron romper el vidrio del vehículo con sus armas, lo cual causó estrés a la familia.

Luego de su detención, Juan Pichún fue trasladado a una comisaría para la respectiva audiencia de detención e investigación formal en un caso en el que también está siendo investigado su hermano, Rafael Pichún, también líder espiritual (werken) de la comunidad de Temulemu. El 27 de junio de 2025, un día después de su detención, el Juzgado de Letras y Garantía de Purén ordenó prisión preventiva para Juan Pichún, acusándolo, sin pruebas suficientes, de ser el autor intelectual de dos atentados incendiarios que ocurrieron en el 2021 en diferentes localidades de la Araucanía. El Juzgado justificó la prisión preventiva de Juan Pichún sobre la base del <a href="https://leyes-cl.com/codigo_procesal_penal/140.htm" rel="external">artículo 140 del Código procesal penal chileno</a>, pese a que su prisión preventiva no es indispensable para el éxito de las diligencias precisas ni existe peligro de que se dé a la fuga, como lo requiere el código, dado que no existió en ningún momento un indicio de que fuera a evadir la justicia y, como se detalla más abajo, él mismo interpuso un recurso de amparo para entender de qué se le estaba investigando, en diciembre de 2024.

El 25 de junio de 2025, un día antes de su detención, Juan Pichún intervino en nombre de la FIDH en la 59ª sesión del Consejo de Derechos Humanos de las Naciones Unidas (<a href="https://webtv.un.org/en/asset/k15/k15dzwhd3e?kalturaStartTime=7213&amp;config[playback=%7B%22audioLanguage%22:%22en%22%7D&amp;config[ui" rel="external">UNTV</a>, timestamp 01:52:10), en un diálogo interactivo con la Relatora Especial sobre la independencia de los magistrados y abogados, Margaret Satterthwaite, después de que ésta presentara un <a href="https://docs.un.org/es/A/HRC/59/52/Add.1" rel="external">informe sobre su visita a Chile</a> donde, entre otras cosas, expresó preocupación por el acceso a la justicia de pueblos indígenas e instó al Estado de Chile a que defienda los derechos sobre la tierra de los pueblos indígenas. Dada la proximidad entre su detención y su participación en el Consejo, el Observatorio teme que su detención se haya producido como represalia por su participación.

Desde el 26 de noviembre de 2024, existe una orden de detención abierta contra Juan Pichún, de la que sólo tuvo conocimiento tras presentar un recurso de amparo, después de que se viera a policías preguntando por él en su comunidad indígena de Temulemu en diciembre de 2024. Esta orden de detención fue emitida confidencialmente por la Fiscalía, y el Sr. Pichún nunca fue notificado formalmente al respecto, ni llamado a comparecer ante un tribunal de justicia. Al tratarse de una orden de detención «secreta», y al no haber sido notificado, no pudo impugnarla directamente.

El Observatorio recuerda que la detención de una autoridad ancestral, espiritual, como Juan Pichún, vulnera los estándares internacionales de derechos humanos que exigen a los estados garantizar el respeto de líderes indígenas y evitar medidas de privación de libertad cuando existan otras alternativas. En efecto, el Relator Especial de Naciones Unidas sobre los derechos de los pueblos indígenas ha sostenido en varios informes (A/HRC/39/17 (2018)) que <i>“los estados deben evitar la detención arbitraria de autoridades tradicionales indígenas, especialmente cuando existen alternativas a la privación de libertad. Su detención puede constituir una forma de criminalización de sus funciones tradicionales,”</i> un principio también ratificado por el <a href="https://www.corteidh.or.cr/docs/casos/articulos/seriec_279_esp.pdf" rel="external">caso de la Corte Interamericana de Derechos Humanos, Norín Catrimán y otros vs. Chile, sentencia de 29 de mayo de 2014</a>. En este caso, la justicia chilena podría perfectamente seguir su investigación sin tener a Juan Pichún y a su hermano en prisión hasta la fecha de un eventual juicio.

El Observatorio condena enérgicamente la detención arbitraria del Sr. Juan Pichún, que podría ser una represalia por su labor de defensa de los derechos indígenas en Chile y por su colaboración con un órgano de derechos humanos de las Naciones Unidas.

El Observatorio exige a las autoridades chilenas liberar de manera inmediata e incondicional al Sr. Juan Pichún y a todas las personas defensoras de derechos humanos detenidas arbitrariamente en Chile, y respetar en todas circunstancias el derecho a la tierra de las comunidades indígenas así como la posibilidad de considerar medidas alternativas a la prisión preventiva para los líderes espirituales indígenas.]]></description>

		<title>RDC : Menaces contre le journaliste Joel Mbiya Kanyinda</title>

					<description><![CDATA[L’Observatoire a été informé des menaces et actes d’intimidation à l’encontre de M. <strong>Joel Mbiya Kanyinda</strong>, journaliste pour le site d’information Kis24.info à Kisangani, spécialisé dans l’investigation, l’alerte citoyenne et la dénonciation des violations des droits humains, et coordonnateur provincial de Filimbi Tshopo, mouvement citoyen qui lutte pour la démocratie et le respect des droits à la liberté d'expression, d'association et de rassemblement, et contre la mauvaise gouvernance et les violations des droits humains, en mobilisant particulièrement la jeunesse congolaise.

Le 18 avril 2025, Joel Mbiya Kanyinda a publié un <a href="https://www.facebook.com/photo/?fbid=9529633913770825&amp;set=a.170371579697152" target="_blank" rel="noopener" data-link-id="1445760758">message</a> sur sa page Facebook dénonçant les irrégularités du processus de passation d’un marché public conclu le 19 novembre 2024 pour la réalisation d’un documentaire sur la guerre des six jours à Kisangani<a href="https://preview.mailerlite.com/d0l1w0c5j5#sdfootnote1sym">1</a> commandé par le Fonds de réparation des indemnisations des victimes des activités illicites de l’Ouganda en République démocratique du Congo (FRIVAO)<a href="https://preview.mailerlite.com/d0l1w0c5j5#sdfootnote2sym">2</a> au studio DIVO pour un montant de 1,2 million de dollars (approximativement 1,07 million d’Euros). Selon les informations reçues, le FRIVAO n'aurait procédé à aucun appel d’offres public, comme l’exige pourtant la réglementation en vigueur pour une opération d’un tel montant. Le marché aurait été passé de gré à gré, sans aucune transparence, et le Président du Conseil d’administration du FRIVAO a déclaré dans une lettre officielle (Réf. : N/RBKL/PRES CA/FRIVAO/KIS/2025, datée du 27 mars 2025) ne pas avoir été informé de cette opération. Selon les révélations de M. Kanyinda, le film devait être livré sous 48 jours après la passation du marché, mais six mois plus tard, le documentaire en question n’a toujours pas été présenté, ce qui soulève des doutes sérieux sur la réalité de sa production.

Quelques minutes après la publication de ces accusations sur Facebook, M. Chançard Bolukola, coordonnateur <em>ad interim</em> du FRIVAO, a contacté M. Kanyinda via la messagerie privée du réseau social en l’accusant de « trahison ». Peu de temps après, Jadot Bakam Kalala, proche de M. Bolukola, a appelé M. Kanyinda pendant plus de 20 minutes pour essayer de le convaincre de modifier sa publication, ce qu’il a refusé.

Le 19 avril 2025, M. Gentil Sefu, militant pro-démocratique reconnu, qui occupe actuellement un poste <em>ad hoc</em> au sein de la commission de la société civile du FRIVAO, a également tenté de persuader M. Kanyinda d’effacer sa publication, via des appels et messages vocaux sur WhatsApp, affirmant qu’elle contenait de fausses accusations. Il l’a accusé auprès de plusieurs personnes, y compris certains de ses collègues du mouvement Filimbi, d’être corrompu par le président du Groupe Lotus, M. <strong>Dismas Kitenge</strong>, dans une claire manœuvre visant à nuire à la réputation des deux défenseurs des droits humains.

Des appels et messages anonymes, y compris des menaces de mort et des pressions directes se sont ensuite multipliés dans le but d’intimider M. Kanyinda et de le forcer à retirer son article ou à le modifier, ce qu’il a refusé de faire.

L’Observatoire exprime sa vive inquiétude face aux menaces et actes d’intimidation à l’encontre de Joel Mbiya Kanyinda, qui ne semblent viser qu’à le dissuader d’exercer ses activités légitimes de défense des droits humains et son droit à la liberté d’expression.

L’Observatoire appelle les autorités congolaises à tout mettre en œuvre pour faire cesser ces menaces et actes d’intimidation, à mener une enquête indépendante, rigoureuse, impartiale et transparente afin d’en identifier les responsables et de les traduire devant un tribunal indépendant, compétent et impartial. L’Observatoire appelle également les autorités congolaises à respecter la loi n° 23/027 du 15 juin 2023 relative à la protection et à la responsabilité du défenseur des droits de l’Homme en RDC, notamment ses articles 13, relatif au droit d’informer sur les violations des droits humains, 14 et 18 relatifs à la protection des défenseur·es, et 15 relatif à la punition des violations commises à l’égard des défenseur·es.

<em><a href="https://preview.mailerlite.com/d0l1w0c5j5#sdfootnote1anc">1</a> Les armées du Rwanda et de l’Ouganda ont envahi l’est de la RDC durant la deuxième guerre du Congo (1998-2003). En juin 2000, les deux armées d’occupation se sont affrontées violemment pour prendre le contrôle de la ville de Kisangani et de ses ressources naturelles, dans le nord-est de la RDC, au cours de la guerre dite « des Six jours ». Cet affrontement à Kisangani a causé la mort de plus de 1.000 civil·es, et occasionné plusieurs centaines de blessé·es, et de nombreux dégâts dans la ville. </em>

<em><a href="https://preview.mailerlite.com/d0l1w0c5j5#sdfootnote2anc">2</a> Dans son arrêt sur la question des réparations en l’affaire <a href="https://www.icj-cij.org/fr/affaire/116" target="_blank" rel="noopener" data-link-id="1445760766">Activités armées sur le territoire du Congo (République démocratique du Congo c. Ouganda)</a> rendu le 9 février 2022, la Cour internationale de Justice, organe judiciaire principal de l’Organisation des Nations unies, a ordonné à l’Ouganda de verser 325 millions de dollars d’indemnités à la RDC au titre des dommages causés par les violations d’obligations internationales de son fait, telles que constatées par la Cour dans son arrêt du 19 décembre 2005. Le Fonds spécial de réparation et d’indemnisation des victimes des activités armées de l’Ouganda en RDC (FRIVAO) a été instauré par décret des autorités de la RDC en 2019 et a commencé à être alimenté par l’Ouganda en 2022. En juin 2024, l’indemnisation des victimes a commencé mais la gestion de ce Fonds fait l’objet de nombreuses controverses, ainsi que de soupçons de corruption. </em>]]></description>
										<content:encoded><![CDATA[L’Observatoire a été informé des menaces et actes d’intimidation à l’encontre de M. <strong>Joel Mbiya Kanyinda</strong>, journaliste pour le site d’information Kis24.info à Kisangani, spécialisé dans l’investigation, l’alerte citoyenne et la dénonciation des violations des droits humains, et coordonnateur provincial de Filimbi Tshopo, mouvement citoyen qui lutte pour la démocratie et le respect des droits à la liberté d'expression, d'association et de rassemblement, et contre la mauvaise gouvernance et les violations des droits humains, en mobilisant particulièrement la jeunesse congolaise.

Le 18 avril 2025, Joel Mbiya Kanyinda a publié un <a href="https://www.facebook.com/photo/?fbid=9529633913770825&amp;set=a.170371579697152" target="_blank" rel="noopener" data-link-id="1445760758">message</a> sur sa page Facebook dénonçant les irrégularités du processus de passation d’un marché public conclu le 19 novembre 2024 pour la réalisation d’un documentaire sur la guerre des six jours à Kisangani<a href="https://preview.mailerlite.com/d0l1w0c5j5#sdfootnote1sym">1</a> commandé par le Fonds de réparation des indemnisations des victimes des activités illicites de l’Ouganda en République démocratique du Congo (FRIVAO)<a href="https://preview.mailerlite.com/d0l1w0c5j5#sdfootnote2sym">2</a> au studio DIVO pour un montant de 1,2 million de dollars (approximativement 1,07 million d’Euros). Selon les informations reçues, le FRIVAO n'aurait procédé à aucun appel d’offres public, comme l’exige pourtant la réglementation en vigueur pour une opération d’un tel montant. Le marché aurait été passé de gré à gré, sans aucune transparence, et le Président du Conseil d’administration du FRIVAO a déclaré dans une lettre officielle (Réf. : N/RBKL/PRES CA/FRIVAO/KIS/2025, datée du 27 mars 2025) ne pas avoir été informé de cette opération. Selon les révélations de M. Kanyinda, le film devait être livré sous 48 jours après la passation du marché, mais six mois plus tard, le documentaire en question n’a toujours pas été présenté, ce qui soulève des doutes sérieux sur la réalité de sa production.

Quelques minutes après la publication de ces accusations sur Facebook, M. Chançard Bolukola, coordonnateur <em>ad interim</em> du FRIVAO, a contacté M. Kanyinda via la messagerie privée du réseau social en l’accusant de « trahison ». Peu de temps après, Jadot Bakam Kalala, proche de M. Bolukola, a appelé M. Kanyinda pendant plus de 20 minutes pour essayer de le convaincre de modifier sa publication, ce qu’il a refusé.

Le 19 avril 2025, M. Gentil Sefu, militant pro-démocratique reconnu, qui occupe actuellement un poste <em>ad hoc</em> au sein de la commission de la société civile du FRIVAO, a également tenté de persuader M. Kanyinda d’effacer sa publication, via des appels et messages vocaux sur WhatsApp, affirmant qu’elle contenait de fausses accusations. Il l’a accusé auprès de plusieurs personnes, y compris certains de ses collègues du mouvement Filimbi, d’être corrompu par le président du Groupe Lotus, M. <strong>Dismas Kitenge</strong>, dans une claire manœuvre visant à nuire à la réputation des deux défenseurs des droits humains.

Des appels et messages anonymes, y compris des menaces de mort et des pressions directes se sont ensuite multipliés dans le but d’intimider M. Kanyinda et de le forcer à retirer son article ou à le modifier, ce qu’il a refusé de faire.

L’Observatoire rappelle que ces actes se produisent dans un contexte <a href="https://www.fidh.org/IMG/pdf/20240823_fidh_rapport-obs-rdc_fr_web-2.pdf" target="_blank" rel="noopener" data-link-id="1445760761">d’attaques systématiques contre les défenseur·es des droits humains et de restriction manifeste de l’espace civique en RDC</a>, en particulier depuis l’accession à un second mandat du président Félix Tshisekedi en décembre 2023. La situation des <a href="https://www.omct.org/fr/ressources/declarations/lomct-exhorte-le-gouvernement-congolais-%C3%A0-mettre-fin-aux-intimidations-visant-les-journalistes-et-les-d%C3%A9fenseur-es-des-droits-humains" target="_blank" rel="noopener" data-link-id="1445760762">journalistes et défenseur·es des droits humains</a> s’est par ailleurs gravement détériorée depuis janvier 2025, avec l’intensification du conflit à l’est du pays entre le M23, soutenu par l’armée rwandaise selon les Nations unies, et l’armée régulière de la RDC (FARDC). Les groupes armés rebelles et le gouvernement congolais réduisent au silence les voix qui dénoncent les abus et violations des droits humains, comme celle du journaliste <a href="https://www.omct.org/fr/ressources/declarations/rdc-des-journalistes-et-d%C3%A9fenseur-es-des-droits-humains-pris-es-pour-cibles-%C3%A0-bukavu" target="_blank" rel="noopener" data-link-id="1445760763"><strong>Amisi Musada Emé</strong><strong>rite</strong></a><strong>,</strong> agressé le 15 avril 2025 à Bukavu.

L’Observatoire exprime sa vive inquiétude face aux menaces et actes d’intimidation à l’encontre de Joel Mbiya Kanyinda, qui ne semblent viser qu’à le dissuader d’exercer ses activités légitimes de défense des droits humains et son droit à la liberté d’expression.

L’Observatoire appelle les autorités congolaises à tout mettre en œuvre pour faire cesser ces menaces et actes d’intimidation, à mener une enquête indépendante, rigoureuse, impartiale et transparente afin d’en identifier les responsables et de les traduire devant un tribunal indépendant, compétent et impartial. L’Observatoire appelle également les autorités congolaises à respecter la loi n° 23/027 du 15 juin 2023 relative à la protection et à la responsabilité du défenseur des droits de l’Homme en RDC, notamment ses articles 13, relatif au droit d’informer sur les violations des droits humains, 14 et 18 relatifs à la protection des défenseur·es, et 15 relatif à la punition des violations commises à l’égard des défenseur·es.

En juin 2000, les deux armées d’occupation se sont affrontées violemment pour prendre le contrôle de la ville de Kisangani et de ses ressources naturelles, dans le nord-est de la RDC, au cours de la guerre dite « des Six jours ». Cet affrontement à Kisangani a causé la mort de plus de 1.000 civil·es, et occasionné plusieurs centaines de blessé·es, et de nombreux dégâts dans la ville. </em>

Ouganda)</a> rendu le 9 février 2022, la Cour internationale de Justice, organe judiciaire principal de l’Organisation des Nations unies, a ordonné à l’Ouganda de verser 325 millions de dollars d’indemnités à la RDC au titre des dommages causés par les violations d’obligations internationales de son fait, telles que constatées par la Cour dans son arrêt du 19 décembre 2005. Le Fonds spécial de réparation et d’indemnisation des victimes des activités armées de l’Ouganda en RDC (FRIVAO) a été instauré par décret des autorités de la RDC en 2019 et a commencé à être alimenté par l’Ouganda en 2022. En juin 2024, l’indemnisation des victimes a commencé mais la gestion de ce Fonds fait l’objet de nombreuses controverses, ainsi que de soupçons de corruption. </em>]]></content:encoded>
