		<title>Colombia: Estigmatización y amenazas en contra del defensor Juan Camilo Villalobos</title>

					<description><![CDATA[El Observatorio ha recibido información sobre la estigmatización, difamación pública, y amenazas a la vida en contra del defensor de derechos humanos, el Sr. <strong>Juan Camilo Villalobos</strong>, y de su familia. El Sr. Juan Camilo Villalobos consolidó su trayectoria como activista durante las movilizaciones sociales en Colombia entre 2019 y 2021, así como en proyectos orientados a la transformación social y a la construcción de memoria histórica. Como activista, el Sr. Villalobos fue recientemente parte de la delegación colombiana en tierra de la Global Sumud Flotilla. Profesionalmente, actualmente el Sr. Villalobos es también contratista de la Consejería Presidencial para los Derechos Humanos.

El 3 de octubre de 2025 – tras una protesta ocurrida el 2 de octubre en Bogotá delante del edificio de la Asociación Nacional de Empresarios de Colombia (ANDI), en solidaridad con Palestina – el Sr. Daniel Briceño, concejal de Bogotá por el partido Centro Democrático, escribió en su cuenta de la <a href="https://click.mailerlite.com/link/c/YT0yODY5ODUzMzI0OTczMTg0MzQxJmM9bDd5MSZiPTE0OTEzMjE3MzAmZD12MnoyZDNo.g5h2ghQsXfd7EGz0CX3oAley1mf1f6ek8wWT82fuH5E" target="_blank" rel="noopener" data-link-id="1491321730">red social X</a> que el Sr. Villalobos "<em>convocó el hostigamiento contra la ANDI</em>”. La protesta del día 2 de octubre de 2025 tenía como objetivo que la ANDI, que reúne más de mil empresarios, cortara relaciones comerciales con Israel por el genocidio y violaciones de derechos humanos cometidas en Palestina.

Con este mensaje, el Sr. Briceño asoció el liderazgo y participación del Sr. Villalobos en condenación del genocidio y en solidaridad contra el pueblo palestino a hechos de violencia que habrán allegadamente sucedido en la misma protesta. Las declaraciones del Sr. Briceño hicieron caso omiso de las intervenciones hechas por el Sr. Villalobos, que invitó a <a href="https://click.mailerlite.com/link/c/YT0yODY5ODUzMzI0OTczMTg0MzQxJmM9bDd5MSZiPTE0OTEzMjE3MzQmZD11OWQ5azVi.A3T3eZ0QnKsB1TSvWnSGuWtpkdqGBGfs8i8W5EmM4TQ" target="_blank" rel="noopener" data-link-id="1491321734">que las movilizaciones se hicieran de manera pacífica</a>.

Desde entonces y hasta la fecha de publicación de este llamado urgente, el Sr. Villalobos ha sido estigmatizado por <a href="https://click.mailerlite.com/link/c/YT0yODY5ODUzMzI0OTczMTg0MzQxJmM9bDd5MSZiPTE0OTEzMjE3MzYmZD1nMXU2dTl6.wQFD4spsIGeS_pFRiOfW1QFJhieOZgLZuY28sDoolcc" target="_blank" rel="noopener" data-link-id="1491321736">medios masivos de comunicación</a> en Colombia y ha venido recibiendo insultos, comentarios difamatorios, que constituyen ataques y amenazas digitales en la red social X, debido a su participación en el equipo en tierra de la delegación de la Global Sumud Flotilla. Entre ellos, personas desconocidas lo amenazaron con conseguir su lugar de residencia para causar daños materiales y físicos en su contra y en contra de su familia. Algunos ataques y amenazas digitales publicados en esta red social incluyen: “<em>Vamos a matar a ese HP. ¡Dirección!”; “Dénle una píldora marca indumil sacada de un dispensador 9 mm esa acaba con estas pestes de raíz”.</em>

Los mensajes en contra del defensor de derechos humanos lo estigmatizan como “terrorista”, “anti-empresa”, “guerrillero”, entre otros adjetivos que buscan deslegitimar su labor como defensor de los derechos humanos. En el contexto del conflicto armado colombiano, <a href="https://click.mailerlite.com/link/c/YT0yODY5ODUzMzI0OTczMTg0MzQxJmM9bDd5MSZiPTE0OTEzMjE3NDAmZD1pMXczeDB1.pvEng_RPvzC_YgvSIIHrZNq45iZg0-TK5HaCMRGB-AA" target="_blank" rel="noopener" data-link-id="1491321740">estas etiquetas han sido historicamente utilizadas para justificar la persecución, judicialización o asesinato de defensores de derechos humanos y de su labor legítima.</a> Este conjunto de ataques y amenazas digitales han causado serias afectaciones a la salud emocional del Sr. Villalobos, así como a la de su esposa, padre, madre y hermano.

El 5 de octubre de 2025, el Sr. Villalobos presentó una denuncia penal ante la Fiscalía General de la Nación por el delito de amenazas contra defensores de derechos humanos y servidores públicos (artículo 188E del Código Penal colombiano), así como por hostigamiento, injuria, calumnia y violación de datos personales.

Sumado a lo anterior, el concejal Daniel Briceño alude en su mensaje al trabajo actual de Juan Camilo Villalobos como contratista de la Consejería Presidencial para los Derechos Humanos. Esta referencia busca vincular de manera estigmatizante su labor independiente como defensor de derechos humanos con su función profesional, con el propósito de insinuar falsamente que habría utilizado recursos públicos en las movilizaciones y trata de involucrar al gobierno actual en los hechos supuestamente ocurridos durante la protesta del 2 de octubre de 2025.

El 9 de octubre de 2025, el Departamento Administrativo de la Presidencia de la República (DAPRE) emitió un <a href="https://click.mailerlite.com/link/c/YT0yODY5ODUzMzI0OTczMTg0MzQxJmM9bDd5MSZiPTE0OTEzMjE3NDMmZD1kNXIybDNn.aGW-zn1AEXdjDn7jozN4lfhrSHENYRvJrwBh3jbq7aU" target="_blank" rel="noopener" data-link-id="1491321743">comunicado</a> en donde afirmó que las labores del Sr. Villalobos “<em>corresponden a funciones técnicas y profesionales específicas, sin relación alguna con los eventos reportados durante las manifestaciones. De manera independiente, el ciudadano desarrolla actividades como activista y defensor de derechos humanos, e integra la delegación colombiana en tierra de la Flotilla Global Sumud, iniciativa de carácter humanitario que busca llevar ayuda al pueblo palestino”.</em>

El 16 de octubre de 2025, la Unidad Nacional de Protección, le otorgó medidas provisionales de protección, consistentes en la asignación de un escolta y un chaleco antibalas.

El Observatorio condena enérgicamente los ataques mediáticos, la estigmatización y amenazas dirigidos contra Juan Camilo Villalobos, los cuales incluyen claros componentes de violencia contra su seguridad y la de su familia. Además, estos ataques pretenden obstaculizar su legítima labor en la lucha de solidaridad contra el genocidio en Palestina.

El Observatorio denuncia los graves perjuicios emocionales y psicológicos que ha causado la difamación pública, las amenazas y la estigmatización en contra del Sr. Villalobos y de su familia.

		<title>Georgia: Arbitrary detention and judicial harassment of pro-democracy activist Nino Datashvili</title>

					<description><![CDATA[The Observatory has been alerted about the arbitrary detention and judicial harassment of Ms <strong>Nino Datashvili,</strong> a pro-democracy activist and civic education teacher in Tbilisi, Georgia, and monitored the beginning of her trial, which took place in Tbilisi on 21 August 2025.

On 9 June 2025, Nino Datashvili attempted to attend the hearings of <a href="https://www.omct.org/en/resources/urgent-interventions/georgia-end-the-arbitrary-detention-of-human-rights-defender-zviad-tsetskhladze" target="_blank" rel="noopener" data-link-id="1473640037">eight peaceful demonstrators</a> in Tbilisi City Court: Zviad Tsetskhladze, Vepkhia Kasradze, Vasil Kadzelashvili, Giorgi Gorgadze, Irakli Miminoshvili, Insaf Aliyev, Tornike Goshadze, and Nikoloz Javakhishvili, who are still held in preventive detention, as part of a broader effort to silence the next generation of independent voices, including aspiring lawyers and pro-European integration human rights defenders in Georgia. After bailiffs prevented her from entering the courtroom, Ms Datashvili asked on what legal grounds they were acting, before being forcibly removed from the building by several men. The next day, an investigation was launched into the alleged assault on a bailiff of the Tbilisi City Court during the performance of his official duties.

On 20 June 2025, Ms Datashvili was arbitrarily arrested in the streets of Tbilisi and placed in custody following a decision by Tbilisi City Court Judge Lela Kaliche. If convicted, she faces up to seven years in prison under part 3 of Article 353 of Georgia’s Criminal Code, which pertains to resistance, threats, or violence against a police officer or another representative of the authorities.

On 2 August 2025, the Tbilisi City Court granted the prosecution’s motion to subject Ms Datashvili to a compulsory psychiatric examination, relying on a 2019 medical record that referred only to a spinal condition accompanied by “psycho-emotional lability”. The ruling authorised her forcible admission to a psychiatric institution for up to 20 days, despite the appeal and her doctor’s statement that he had never assessed her mental health and had only treated her spinal condition. The Court of Appeal upheld this decision, triggering public outcry from human rights defenders, psychiatrists, and experts, who <a href="https://gcrt.ge/%E1%83%9B%E1%83%98%E1%83%9B%E1%83%90%E1%83%A0%E1%83%97%E1%83%95%E1%83%90-%E1%83%A4%E1%83%A1%E1%83%98%E1%83%A5%E1%83%98%E1%83%99%E1%83%A3%E1%83%A0%E1%83%98-%E1%83%AF%E1%83%90%E1%83%9C%E1%83%9B%E1%83%A0/" target="_blank" rel="noopener" data-link-id="1473640038">denounced</a> the measure as a form of political persecution. In response to the controversy, prosecutors arranged for experts from the L. Samkharauli Forensic Bureau to examine Ms Datashvili directly in prison, without informing her or her lawyers in advance. On 6 August 2025, these experts interviewed her in custody, raising concerns about lack of consent and procedural violations.

On 8 August, the Tbilisi City Court upheld the pre-trial detention of Ms Datashvili, citing “risks of absconding, witness tampering, and committing new crimes”.

On 21 August, the substantive hearing of the case began before the Tbilisi City Court. On this day, the prosecutor’s office presented a forensic medical examination report based on the interview conducted on 6 August, stating that Ms Datashvili does not have any mental health needs. However, the defense requested this report to be inadmissible on the grounds that Ms Datashvili had not been informed of the nature of this interview and therefore could not have given her informed consent to it. Ms Datashvili’s lawyers also stated that the charges of “Attack on a law enforcement officer during the performance of his official duties” under Article 353 of Georgia’s Criminal Code cannot withstand legal scrutiny, since the charge does not meet the criteria regarding personal safety of the bailiffs who first used physical force against her, before she attempted either to escape or to use her hands. Ms Datashvili’s actions were therefore merely an attempt to defend herself from the bailiffs’ use of force.The hearing is scheduled to resume on 8 September, when the Court will also rule on the admissibility of the medical examination report.

The Observatory <a href="https://www.fidh.org/en/region/europe-central-asia/georgia/georgia-law-enforcement-officers-must-be-held-accountable-for-the" target="_blank" rel="noopener" data-link-id="1473640040">recalls</a> that protests erupted throughout Georgia in November 2024, following the government’s announcement of the suspension of the negotiations over Georgia’s accession to the European Union, which came shortly after the re-election of the ruling Georgia Dream party in an unfair election. While the protests remained overwhelmingly peaceful, the police used water cannons and tear gas to disperse the crowds, as well as excessive force and mistreatment during transportation, resulting in numerous injuries to protesters and over 480 arbitrary arrests, some of them amounting to inhuman treatment and, possibly, torture.

The Observatory also recalls that Georgia’s worsening human-rights environment is also inextricably linked to the <a href="https://www.fidh.org/en/region/europe-central-asia/georgia/georgia-adoption-of-the-new-foreign-agents-registration-act" target="_blank" rel="noopener" data-link-id="1473640043">adoption of the repressive</a> ‘foreign agents’ legislation, including the Law ‘On Transparency of Foreign Influence,’ which came into force in May 2024, the ‘<a href="https://www.fidh.org/en/region/europe-central-asia/georgia/georgia-adoption-of-the-new-foreign-agents-registration-act" target="_blank" rel="noopener" data-link-id="1473640045">Foreign Agents Registration Act’</a>, and the amendments to the Law ‘On Grants’. These laws severely and unlawfully restrict the rights to freedom of association, expression and the right to privacy, creating a drastic, and potentially devastating impact on Georgia’s civil society.

The Observatory is deeply concerned about the obstacles to Ms Datashvili’s access to healthcare while in custody. She is suffering from severe physical pain and requires urgent surgery, yet her repeated requests for medical care have been disregarded, despite her complaints to the General Inspectorate and the Prosecutor General’s Office.

The Observatory strongly condemns the continued arbitrary detention, lack of access to healthcare, use of psychiatric label to stigmatize her which appear to be aimed only aimed at punishing her for her legitimate human rights activities and her defense of the right to freedom of assembly.

The Observatory calls on the Georgian authorities to immediately and unconditionally release Ms Nino Datashvili and all other arbitrarily detained human rights defenders and demonstrators in the country, and to put an end to all forms of judicial harassment against them.]]></description>

On 2 August 2025, the Tbilisi City Court granted the prosecution’s motion to subject Ms Datashvili to a compulsory psychiatric examination, relying on a 2019 medical record that referred only to a spinal condition accompanied by “psycho-emotional lability”. The ruling authorised her forcible admission to a psychiatric institution for up to 20 days, despite the appeal and her doctor’s statement that he had never assessed her mental health and had only treated her spinal condition. The Court of Appeal upheld this decision, triggering public outcry from human rights defenders, psychiatrists, and experts, who <a href="https://gcrt.ge/%E1%83%9B%E1%83%98%E1%83%9B%E1%83%90%E1%83%A0%E1%83%97%E1%83%95%E1%83%90-%E1%83%A4%E1%83%A1%E1%83%98%E1%83%A5%E1%83%98%E1%83%99%E1%83%A3%E1%83%A0%E1%83%98-%E1%83%AF%E1%83%90%E1%83%9C%E1%83%9B%E1%83%A0/" target="_blank" rel="noopener" data-link-id="1473640038">denounced</a> the measure as a form of political persecution. In response to the controversy, prosecutors arranged for experts from the L. Samkharauli Forensic Bureau to examine Ms Datashvili directly in prison, without informing her or her lawyers in advance. On 6 August 2025, these experts interviewed her in custody, raising concerns about lack of consent and procedural violations.

On 8 August, the Tbilisi City Court upheld the pre-trial detention of Ms Datashvili, citing “risks of absconding, witness tampering, and committing new crimes”.

On 21 August, the substantive hearing of the case began before the Tbilisi City Court. On this day, the prosecutor’s office presented a forensic medical examination report based on the interview conducted on 6 August, stating that Ms Datashvili does not have any mental health needs. However, the defense requested this report to be inadmissible on the grounds that Ms Datashvili had not been informed of the nature of this interview and therefore could not have given her informed consent to it. Ms Datashvili’s lawyers also stated that the charges of “Attack on a law enforcement officer during the performance of his official duties” under Article 353 of Georgia’s Criminal Code cannot withstand legal scrutiny, since the charge does not meet the criteria regarding personal safety of the bailiffs who first used physical force against her, before she attempted either to escape or to use her hands. Ms Datashvili’s actions were therefore merely an attempt to defend herself from the bailiffs’ use of force.The hearing is scheduled to resume on 8 September, when the Court will also rule on the admissibility of the medical examination report.

The Observatory <a href="https://www.fidh.org/en/region/europe-central-asia/georgia/georgia-law-enforcement-officers-must-be-held-accountable-for-the" target="_blank" rel="noopener" data-link-id="1473640040">recalls</a> that protests erupted throughout Georgia in November 2024, following the government’s announcement of the suspension of the negotiations over Georgia’s accession to the European Union, which came shortly after the re-election of the ruling Georgia Dream party in an unfair election. While the protests remained overwhelmingly peaceful, the police used water cannons and tear gas to disperse the crowds, as well as excessive force and mistreatment during transportation, resulting in numerous injuries to protesters and over 480 arbitrary arrests, some of them amounting to inhuman treatment and, possibly, torture.

The Observatory also recalls that Georgia’s worsening human-rights environment is also inextricably linked to the <a href="https://www.fidh.org/en/region/europe-central-asia/georgia/georgia-adoption-of-the-new-foreign-agents-registration-act" target="_blank" rel="noopener" data-link-id="1473640043">adoption of the repressive</a> ‘foreign agents’ legislation, including the Law ‘On Transparency of Foreign Influence,’ which came into force in May 2024, the ‘<a href="https://www.fidh.org/en/region/europe-central-asia/georgia/georgia-adoption-of-the-new-foreign-agents-registration-act" target="_blank" rel="noopener" data-link-id="1473640045">Foreign Agents Registration Act’</a>, and the amendments to the Law ‘On Grants’. These laws severely and unlawfully restrict the rights to freedom of association, expression and the right to privacy, creating a drastic, and potentially devastating impact on Georgia’s civil society.

The Observatory is deeply concerned about the obstacles to Ms Datashvili’s access to healthcare while in custody. She is suffering from severe physical pain and requires urgent surgery, yet her repeated requests for medical care have been disregarded, despite her complaints to the General Inspectorate and the Prosecutor General’s Office.

The Observatory strongly condemns the continued arbitrary detention, lack of access to healthcare, use of psychiatric label to stigmatize her which appear to be aimed only aimed at punishing her for her legitimate human rights activities and her defense of the right to freedom of assembly.

		<title>Russia : Inclusion of Indigenous Peoples’ and national minorities’ rights organisations in the list of “extremist organisations”</title>

<strong>On July 25, 2024, the Russian authorities designated several </strong><strong>Indigenous Peoples’ and national minorities’ rights organisations and other groups as “extremist organisations”. The Observatory for the Protection of Human Rights Defenders (FIDH-OMCT) and the Anti-Discrimination Center Memorial (ADC Memorial) urge the Russian authorities to put an immediate end to this escalating crackdown on organisations protecting the rights of Indigenous Peoples and ethnic minorities in Russia and civil society in general.</strong>

<strong>Paris-Geneva-Brussels, August 2, 2024 – </strong>On July 25, 2024, the Ministry of Justice of the Russian Federation included 55 organisations, among them Indigenous Peoples’ and national minorities’ rights organisations in the list of “extremist organisations”.

These organisations have been labelled as “structural divisions” of the so-called “Anti-Russian Separatist Movement,” which was recognised as “extremist” and <a href="https://www.rferl.org/a/russian-supreme-court-bans-nonexistent-separatist-movement/32983541.html" target="_blank" rel="noopener" data-link-id="1348272508">banned</a> by Russia’s Supreme Court on June 7, 2024. This alleged movement, <a href="https://www.currenttime.tv/a/antirossiyskoe-separatistskoe-dvizhenie/32983495.html" target="_blank" rel="noopener" data-link-id="1348272518">which does not formally exist</a>, is defined by the Ministry of Justice as an “international public movement to destroy the multinational unity and territorial integrity of Russia.” This broad definition is considered to aim at facilitating repression against Indigenous Peoples and ethnic minorities organisations, who face up to six years in prison if accused of involvement in the banned “Anti-Russian Separatist Movement.”

Moreover, after their explicit inclusion in the list of “extremist organisations”, the organisations’ members face even higher risks of severe criminal prosecution and arbitrary imprisonment solely for their involvement in these organisations, preventing them from continuing their essential and legitimate actions in safe and effective conditions.

Among the organisations designated as “extremist” on July 25, 2024 is the Aborigen-Forum, an informal association of independent experts, activists, leaders, and public organisations of the small-numbered Indigenous Peoples of the North, Siberia, and the Far East of Russia, and the International Committee of Indigenous Peoples of Russia (ICIPR), an international Indigenous-led organisation that was created in March 2022 as a reaction of several Russian Indigenous leaders and activists to the war in Ukraine.

In Russia, Indigenous communities and minorities <a href="https://adcmemorial.org/en/news/breaking-news/racism-in-russia-report-of-adc-memorial-and-international-committee-of-the-indigenous-peoples-of-russia-to-the-un-cerd/" target="_blank" rel="noopener" data-link-id="1348272528">face severe restrictions to their fundamental rights</a>, including freedom of expression, the right to self-determination and cultural rights, as well as racism, structural discrimination and xenophobia. Russia’s full-scale invasion of Ukraine and the so-called partial mobilisation in September 2021 drastically and disproportionally affected young men from ethnic minorities and Indigenous people living in the poorest regions of Russia, leading to extremely high death rates among mobilised men from Indigenous communities and ethnic minorities. Some of the organisations now labelled as “extremist”, like the <a href="https://www.freeburyatia.org/?lang=en" target="_blank" rel="noopener" data-link-id="1348272537">Free Buryatia Foundation</a> founded in March 2022, which fights against Russia’s war in Ukraine, had already been designated as “undesirable” and “foreign agent” by the Russian authorities, highlighting that the shrinking civic space in the country is particularly affecting Indigenous Peoples’ and minorities’ rights organisations.

The recent decision to include these organisations in the list of “extremist organisations” is part of a context of increasing repression of critical voices in Russia. In a similar move, in March 2024, Russian authorities added the equally non-existent “international LGBT movement” to the list of “extremist and terrorist organisations”, also referring to “its structural units”, thus criminalising all LGBTQI+ activism. After this decision, multiple activists were arrested on grounds of being “extremists”. This decision illustrates a further escalation in efforts to silence the human rights movement.

The Observatory and ADC Memorial stand in solidarity with the targeted Indigenous Peoples’ and minorities’ rights organisations, and strongly condemn this unprecedented repression, as it appears to be aimed solely at punishing these organisations for their peaceful and legitimate human rights activities.

The Observatory and ADC Memorial urge the Russian authorities to reverse this decision, put an end to the banning of Indigenous Peoples’ and minorities’ rights organisations and the criminalisation of their members, and allow them to continue their legitimate activities without any hindrance or fear of reprisal. The two signatory organisations further call on the authorities in Russia to guarantee in all circumstances the right to freedom of association, as enshrined in international human rights standards, and particularly in Article 22 of the International Covenant on Civil and Political Rights.

<strong>On July 25, 2024, the Russian authorities designated several </strong><strong>Indigenous Peoples’ and national minorities’ rights organisations and other groups as “extremist organisations”. The Observatory for the Protection of Human Rights Defenders (FIDH-OMCT) and the Anti-Discrimination Center Memorial (ADC Memorial) urge the Russian authorities to put an immediate end to this escalating crackdown on organisations protecting the rights of Indigenous Peoples and ethnic minorities in Russia and civil society in general.</strong>

<strong>Paris-Geneva-Brussels, August 2, 2024 – </strong>On July 25, 2024, the Ministry of Justice of the Russian Federation included 55 organisations, among them Indigenous Peoples’ and national minorities’ rights organisations in the list of “extremist organisations”.

These organisations have been labelled as “structural divisions” of the so-called “Anti-Russian Separatist Movement,” which was recognised as “extremist” and <a href="https://www.rferl.org/a/russian-supreme-court-bans-nonexistent-separatist-movement/32983541.html" target="_blank" rel="noopener" data-link-id="1348272508">banned</a> by Russia’s Supreme Court on June 7, 2024. This alleged movement, <a href="https://www.currenttime.tv/a/antirossiyskoe-separatistskoe-dvizhenie/32983495.html" target="_blank" rel="noopener" data-link-id="1348272518">which does not formally exist</a>, is defined by the Ministry of Justice as an “international public movement to destroy the multinational unity and territorial integrity of Russia.” This broad definition is considered to aim at facilitating repression against Indigenous Peoples and ethnic minorities organisations, who face up to six years in prison if accused of involvement in the banned “Anti-Russian Separatist Movement.”

Moreover, after their explicit inclusion in the list of “extremist organisations”, the organisations’ members face even higher risks of severe criminal prosecution and arbitrary imprisonment solely for their involvement in these organisations, preventing them from continuing their essential and legitimate actions in safe and effective conditions.

Among the organisations designated as “extremist” on July 25, 2024 is the Aborigen-Forum, an informal association of independent experts, activists, leaders, and public organisations of the small-numbered Indigenous Peoples of the North, Siberia, and the Far East of Russia, and the International Committee of Indigenous Peoples of Russia (ICIPR), an international Indigenous-led organisation that was created in March 2022 as a reaction of several Russian Indigenous leaders and activists to the war in Ukraine.

In Russia, Indigenous communities and minorities <a href="https://adcmemorial.org/en/news/breaking-news/racism-in-russia-report-of-adc-memorial-and-international-committee-of-the-indigenous-peoples-of-russia-to-the-un-cerd/" target="_blank" rel="noopener" data-link-id="1348272528">face severe restrictions to their fundamental rights</a>, including freedom of expression, the right to self-determination and cultural rights, as well as racism, structural discrimination and xenophobia. Russia’s full-scale invasion of Ukraine and the so-called partial mobilisation in September 2021 drastically and disproportionally affected young men from ethnic minorities and Indigenous people living in the poorest regions of Russia, leading to extremely high death rates among mobilised men from Indigenous communities and ethnic minorities. Some of the organisations now labelled as “extremist”, like the <a href="https://www.freeburyatia.org/?lang=en" target="_blank" rel="noopener" data-link-id="1348272537">Free Buryatia Foundation</a> founded in March 2022, which fights against Russia’s war in Ukraine, had already been designated as “undesirable” and “foreign agent” by the Russian authorities, highlighting that the shrinking civic space in the country is particularly affecting Indigenous Peoples’ and minorities’ rights organisations.

The recent decision to include these organisations in the list of “extremist organisations” is part of a context of increasing repression of critical voices in Russia. In a similar move, in March 2024, Russian authorities added the equally non-existent “international LGBT movement” to the list of “extremist and terrorist organisations”, also referring to “its structural units”, thus criminalising all LGBTQI+ activism. After this decision, multiple activists were arrested on grounds of being “extremists”. This decision illustrates a further escalation in efforts to silence the human rights movement.

The Observatory and ADC Memorial stand in solidarity with the targeted Indigenous Peoples’ and minorities’ rights organisations, and strongly condemn this unprecedented repression, as it appears to be aimed solely at punishing these organisations for their peaceful and legitimate human rights activities.

The Observatory and ADC Memorial urge the Russian authorities to reverse this decision, put an end to the banning of Indigenous Peoples’ and minorities’ rights organisations and the criminalisation of their members, and allow them to continue their legitimate activities without any hindrance or fear of reprisal. The two signatory organisations further call on the authorities in Russia to guarantee in all circumstances the right to freedom of association, as enshrined in international human rights standards, and particularly in Article 22 of the International Covenant on Civil and Political Rights.

On July 5, 2024, the Russian Ministry of Justice declared Grigory Vaypan a “foreign agent”, stating that he “disseminated false information about the decisions made by the public authorities of the Russian Federation and their policies, and spoke out against the special military operation in Ukraine. He participated in the creation of messages and materials for an unlimited audience by foreign agents, and also participated as a respondent on information platforms provided by foreign agents. He took part in an event organised by foreign agents.”

This designation is linked to Mr Vaypan’s human rights work in Russia, including defending the right of elderly Russian citizens, known as the “<a href="https://click.mailerlite.com/link/c/YT0yNTM0OTMwNjExNDcxMTI4Mjc2JmM9ZzRtOCZiPTEzNDY0OTk1NzgmZD13MXo5eTZp.PlG3TixEAn5H1DvKbXbIPsJ1rqItVWXejlZHAsf-SwE" target="_blank" rel="noopener" data-link-id="1346499578">children of the Gulag</a>”, to return to the place of residence of their parents who had been deported to Gulag camps during the Soviet terror of the 1930s and 1940s, but also to his prominent rejection and criticism of Russia’s aggression against Ukraine.

In addition, numerous formal and informal restrictions have been imposed on these persons, such as the inability to be elected, the ban on working in the public service or the ban on teaching.

Additionally, the designation of persons and entities as “foreign agents” is highly stigmatising and discrediting, as it implies that such persons or entities serve foreign interests and do not work to the benefit of their own communities or country.

The Observatory strongly condemns the designation of Grigory Vaypan as a “foreign agent” and calls on the Russian authorities to immediately withdraw his name from the register of “foreign agents”.

En su conferencia de prensa matutina del 22 de abril de 2024, el primer mandatario, Andrés Manuel López Obrador, acusó al Centro de Derechos Humanos Fray Bartolomé de Las Casas (Frayba) de estar “buscando crear un ambiente de violencia que no tiene las dimensiones que [desde el Frayba] están registrando”. Como bien lo señala el Relator Especial sobre Libertad de Expresión de la Comisión Interamericana de Derechos Humanos (CIDH), los Estados deben garantizar la libertad de expresión “de quienes coinciden o tienen identidad con el gobierno, pero también, sobre todo, de aquellas personas que tienen opiniones divergentes”, recordando que “la estigmatización puede ser permisiva o generar un ambiente permisivo a que ocurran agresiones contra defensores de derechos humanos y periodistas”.[<a title="Proceso, 22 de abril de 2021. “Relator de la CIDH pide a México reconsiderar (…)" href="https://click.mailerlite.com/link/c/YT0yNDY5Nzc1ODUzOTQxMTY3NjY1JmM9ZzR3OCZiPTEzMTQzNjg2ODEmZD13NGg3eTBp.Vh09cfM03JAnZRqQN133m8cyFZ95RZNei_N7_d4pitg" target="_blank" rel="noopener" data-link-id="1314368681">2</a>] Señalar públicamente a personas defensoras de derechos humanos y periodistas, quienes, como parte de su labor, vigilan y auditan la actuación estatal en relación a la atención de violaciones de derechos humanos, aumenta su exposición a posibles agresiones y ataques violentos, y a la vez restringe el espacio democrático y de defensa de derechos humanos de la ciudadanía.

El Centro de Derechos Humanos Fray Bartolomé de Las Casas lleva 35 años en la defensa y promoción de los derechos humanos en el estado de Chiapas, habiendo acompañado en su trayectoria a víctimas de graves violaciones de derechos humanos en su lucha por la justicia, así como a comunidades y pueblos que defienden su autonomía y libre determinación. Gracias a su ética, rigor y compromiso hacia los derechos humanos se ha consolidado como una de las organizaciones de la sociedad civil más reconocidas en el país, contribuyendo a diario a visibilizar las injusticias y las violencias vividas por las poblaciones más vulnerables del estado. En línea con su misión, el Frayba, en conjunto con otros actores de la sociedad civil mexicana, ha documentado y denunciado la escalada de violencia que ha inundado Chiapas en los últimos tres años, y sus impactos sobre la población civil. La actual coyuntura expone a altos niveles de riesgo a quienes, como el Frayba, acompañan a víctimas de violaciones a derechos humanos en su búsqueda de justicia y reparación, y torna imprescindible el reconocimiento de su labor, así como su protección, por parte de las instituciones públicas de los tres niveles de gobierno.

Por todo lo anterior, las organizaciones firmantes llamamos a que cesen los señalamientos en contra de organizaciones y personas defensoras de derechos humanos en México, y se reconozca públicamente la labor fundamental que desempeñan en favor de la justicia, de la protección y promoción de los derechos humanos y de la construcción de paz. Finalmente, solicitamos que se fortalezca el marco legal, así como los mecanismos diseñados para brindar protección a personas defensoras de derechos humanos y periodistas en México.

Las organizaciones internacionales firmantes expresamos nuestra profunda preocupación por los señalamientos, la deslegitimación y la estigmatización en contra del Centro de Derechos Humanos Fray Bartolomé de las Casas que restringen significativamente su espacio de acción para la defensa de los derechos humanos, exponiendo la organización y a sus integrantes a graves riesgos en el desempeño de su labor.

En su conferencia de prensa matutina del 22 de abril de 2024, el primer mandatario, Andrés Manuel López Obrador, acusó al Centro de Derechos Humanos Fray Bartolomé de Las Casas (Frayba) de estar “buscando crear un ambiente de violencia que no tiene las dimensiones que [desde el Frayba] están registrando”. Asimismo, <a href="https://click.mailerlite.com/link/c/YT0yNDY5Nzc1ODUzOTQxMTY3NjY1JmM9ZzR3OCZiPTEzMTQzNjg2NjImZD1wOGk2cjln.kVKRjXBLEMX4lzlJMB6IUjpnqCr7Z1R8yaUQdrsLROk" target="_blank" rel="noopener" data-link-id="1314368662">señala</a> a la organización de “estar magnificando las cosas”, en referencia a las recientes denuncias del Frayba sobre la situación de violencia que está atravesando el estado de Chiapas desde mediados de 2021, cuando estalló la <a href="https://click.mailerlite.com/link/c/YT0yNDY5Nzc1ODUzOTQxMTY3NjY1JmM9ZzR3OCZiPTEzMTQzNjg2NjQmZD1lM3I0ajhp.Mk0zFWzd4TOCQAlhzrRTANpSLaOxmOROLOuj5Fd7YXQ" target="_blank" rel="noopener" data-link-id="1314368664">disputa</a> entre grupos del crimen organizado por el control territorial. Los mismos mensajes fueron reiterados en la <a href="https://click.mailerlite.com/link/c/YT0yNDY5Nzc1ODUzOTQxMTY3NjY1JmM9ZzR3OCZiPTEzMTQzNjg2NjYmZD1nOWU0ZTFy.bTNGREKk9kr8xio0Z6-CTyIcgVMSKEMMDMM4TL7cL74" target="_blank" rel="noopener" data-link-id="1314368666">conferencia de prensa matutina del día 23 de abril</a>, mientras que unas semanas antes, el 3 de abril de 2024, el presidente <a href="https://click.mailerlite.com/link/c/YT0yNDY5Nzc1ODUzOTQxMTY3NjY1JmM9ZzR3OCZiPTEzMTQzNjg2NzEmZD1oNHQ0ZDR2.ybz2QIyVTIEA1vzQLK8P1dWyc8_ldLPrlrqqdqmlwJo" target="_blank" rel="noopener" data-link-id="1314368671">acusó</a> al Frayba de mentir, por una divergencia sobre las cifras de <a href="https://click.mailerlite.com/link/c/YT0yNDY5Nzc1ODUzOTQxMTY3NjY1JmM9ZzR3OCZiPTEzMTQzNjg2NzImZD1lMmo0aDJn.lTRW0SRIH9KGqDNJxVFRdo9T3BSUDylX4CVSDOa82Rs" target="_blank" rel="noopener" data-link-id="1314368672">personas fallecidas</a> en el marco de un enfrentamiento ocurrido el 31 de marzo de 2024 en el municipio de La Concordia (Chiapas) entre elementos de la Guardia Nacional y un grupo del crimen organizado.

Ambas declaraciones son muestras del patrón de señalamientos por medio de los cuales el ejecutivo deslegitima la labor de defensa de derechos humanos llevada a cabo por centros de derechos humanos, organizaciones de la sociedad civil y colectivos de familiares de personas desaparecidas, así como por periodistas, quienes documentan y denuncian la violencia territorial y las violaciones a derechos humanos, evidenciando la negligencia de las autoridades de los tres niveles del Estado mexicano. 		<title>Russia: Memorial Human Rights Defence Center (HRDC “Memorial”) labelled as “foreign agent”</title>

					<description><![CDATA[The Observatory has been informed about the designation of Memorial Human Rights Defence Center (HRDC “Memorial” or Memorial Centre), a member organisation of FIDH, as a “foreign agent”. HRDC “Memorial” was founded on June 14, 2022, by a team of friends and former employees of the Memorial Human Rights Centre (Memorial HRC), in response to the liquidation of the organisation on December 29, 2021. Memorial HRC was founded in 1993 and became one of the first human rights non-profit organisations in modern-day Russia. Memorial HRC compiled and maintained a list of political prisoners based on the definition endorsed by PACE resolution 1900. It collected information on, monitored, supported, organised campaigns around, and legally and financially assisted victims of politically motivated criminal prosecution and their families. Memorial HRC’s priorities were violations committed by security services, including unlawful use of force and torture, protection of freedom of speech and assembly, violence against women, discrimination, protection of procedural rights, and protection of the interests of non-profit organisations.

On February 2, 2024, the Russian Ministry of Justice declared HRDC “Memorial” a “foreign agent” on their website. The designation of persons and entities as “foreign agents” entails a series of obligations: “foreign agents” are required to submit financial reports every three months, carry out annual mandatory audits, and any information published or disseminated by such entities has to contain a reference indicating that it has been published or disseminated by a “foreign agent”. Any violation of these rules results in a fine, and after a third warning, authorities can initiate criminal proceedings.

The Observatory recalls that on November 17, 2012, the Federal Law “On Amendments to Certain Legislative Acts of the Russian Federation Regarding Regulation of Non-Profit Organisations Performing the Functions of a Foreign Agent” of 20.07.2012 № 121-FZ (Law on NPOs) entered into force. On February 6, 2013, 11 non-profit organisations, including Memorial HRC, filed an application before the European Court of Human Rights (ECtHR), claiming that the law affected their rights guaranteed under Article 11 of the European Convention on Human Rights (Freedom of assembly and association). Since the application before the ECtHR was lodged, all 11 organisations were declared “foreign agents”, including Memorial HRC, which was added to the register of “foreign agents” by the Ministry of Justice on July 21, 2014. In November 2016, after several fines and warnings from state bodies, Memorial HRC denied on its official website that the organisation was a “foreign agent”, denounced the Law on NPOs as contrary to the Russian Constitution and announced that they would appeal their inclusion on the said register to the European Court of Human Rights. The Tverskoy District Court of the city of Moscow examined all the cases of administrative violations and found the organisation and its leader guilty and fined them from 100,000 to 400,000 rubles (approximately 1,000 to 4,000 Euros). The judgments were appealed before the Moscow Municipal Court, but they remained in effect as the court rejected the appeals. In total, the organisation and its leader paid 1,600,000 rubles (approximately 16,135 Euros), which were collected with the assistance of crowdfunding.

On November 8, 2021, the Moscow City Prosecutor’s Office filed an administrative lawsuit to the Moscow City Court to liquidate Memorial HRC, on the grounds of systematic violations of the “foreign agents” legislation. The Prosecutor’s Office also pointed out that some of the publications on the organisation’s website “were aimed at forming an idea among the general public that terrorist and extremist activity is acceptable”. 										<content:encoded><![CDATA[The Observatory has been informed about the designation of Memorial Human Rights Defence Center (HRDC “Memorial” or Memorial Centre), a member organisation of FIDH, as a “foreign agent”. HRDC “Memorial” was founded on June 14, 2022, by a team of friends and former employees of the Memorial Human Rights Centre (Memorial HRC), in response to the liquidation of the organisation on December 29, 2021. Memorial HRC was founded in 1993 and became one of the first human rights non-profit organisations in modern-day Russia. Memorial HRC compiled and maintained a list of political prisoners based on the definition endorsed by PACE resolution 1900. It collected information on, monitored, supported, organised campaigns around, and legally and financially assisted victims of politically motivated criminal prosecution and their families. Memorial HRC’s priorities were violations committed by security services, including unlawful use of force and torture, protection of freedom of speech and assembly, violence against women, discrimination, protection of procedural rights, and protection of the interests of non-profit organisations.

On February 2, 2024, the Russian Ministry of Justice declared HRDC “Memorial” a “foreign agent” on their website. The designation of persons and entities as “foreign agents” entails a series of obligations: “foreign agents” are required to submit financial reports every three months, carry out annual mandatory audits, and any information published or disseminated by such entities has to contain a reference indicating that it has been published or disseminated by a “foreign agent”. Any violation of these rules results in a fine, and after a third warning, authorities can initiate criminal proceedings.

The Observatory recalls that on November 17, 2012, the Federal Law “On Amendments to Certain Legislative Acts of the Russian Federation Regarding Regulation of Non-Profit Organisations Performing the Functions of a Foreign Agent” of 20.07.2012 № 121-FZ (Law on NPOs) entered into force. On February 6, 2013, 11 non-profit organisations, including Memorial HRC, filed an application before the European Court of Human Rights (ECtHR), claiming that the law affected their rights guaranteed under Article 11 of the European Convention on Human Rights (Freedom of assembly and association). Since the application before the ECtHR was lodged, all 11 organisations were declared “foreign agents”, including Memorial HRC, which was added to the register of “foreign agents” by the Ministry of Justice on July 21, 2014. In November 2016, after several fines and warnings from state bodies, Memorial HRC denied on its official website that the organisation was a “foreign agent”, denounced the Law on NPOs as contrary to the Russian Constitution and announced that they would appeal their inclusion on the said register to the European Court of Human Rights. In addition to Oleg Orlov, three other Memorial members were included in the register on February 2, 2024, namely: Mr <strong>Mikhail Chimarov</strong>, chairman of Memorial's Novgorod branch; Mr <strong>Nikita Sokolov</strong>, historian and long-time participant in the Memorial movement; and Mr <strong>Sergey Stepanov</strong>, an activist of the Memorial in Tambov.

Oleg Orlov is accused of “discrediting the actions of the Russian Army” on the grounds of “ideological hostility against traditional spiritual, moral and patriotic values” and “hatred against the social group of servicemen of the Armed Forces” for his article published on November 13, 2022 on the Mediapart website.

The Observatory further recalls that the pressure on Oleg Orlov is related to his consistent human rights and anti-war positions. After the start of Russia’s full-scale invasion of Ukraine, he came out five times with anti-war posters to Red Square and the State Duma in Moscow. All five times, he was <a href="https://www.fidh.org/en/issues/human-rights-defenders/russia-administrative-harassment-and-stigmatisation-of-oleg-orlov" target="_blank" rel="noopener" data-link-id="1280604582">detained and fined</a>.

De igual manera, integrantes del Comité Municipal de Tocoa han denunciado actos de intimidación en sus viviendas y bienes personales.

Por otro lado, se han señalado actos de clientelismo que buscan influenciar el voto de la población de Tocoa, ya que en la misma semana que se planea realizar el cabildo abierto, el alcalde de Tocoa el Sr. Adán Fuentes anunció a nombre del Gobierno Central la entrega de un “Bono Solidario” el cual habría sido entregado de manera discrecional, ya que los representantes de la alcaldía habrían dicho a las y los ciudadanos que no recibirían el bono a menos que estuvieran a favor del alcalde y del grupo EMCO.

El 10 de noviembre de 2023, el alcalde de Tocoa el Sr. Adán Fuentes, quien fue nombrado por la Fiscalía del Distrito Sur de Nueva York en <a href="https://click.mailerlite.com/link/c/YT0yMzY1NTU5MTEyOTk5MTE0NTk3JmM9czh2NiZiPTEyNTM4Mzk3OTQmZD10NW0yZTFm.ff1MBzYw9Ub638YdXTb02rKMrgZcy3JwUDRKr8vALrY" target="_blank" rel="noopener" data-link-id="1253839794">tribunales estadounidenses</a> por supuestos actos de corrupción y por supuestamente haber facilitado protección a grupos narcotraficantes, convocó a una sesión ordinaria de la corporación municipal de Tocoa para celebrarse el 14 de noviembre en la cual se aprobó la celebración de un cabildo abierto para impulsar la instalación de la planta termoeléctrica de la empresa Ecotek, sin informar y difundir ampliamente los posibles impactos sociales, sanitarios y ambientales de este proyecto. Asimismo, la iniciativa cuenta con el respaldo de la Secretaría de Recursos Naturales y Ambiente (SERNA), a pesar de que la empresa aún no tiene la licencia para realizar este proyecto.

El 27 de noviembre de 2023 la corporación municipal extendió una invitación a la comunidad de Tocoa para participar en el cabildo con el fin de socializar y aprobar el proyecto energético el cual se ha presentado como la solución a los problemas energéticos que se viven en la región. Sin embargo, según el estudio de impacto ambiental presentado por la empresa a la SERNA con registro EXP.SLAS-<a href="tel:0000076-20">0000076-20</a>, la electricidad que se generará será para su propio consumo y no para la población.

El Observatorio expresa preocupación por la manera en la que se está llevando a cabo este proceso de consulta, el cual no está considerando factores de transparencia y acceso a la información, inclusión y diálogo. De igual manera, con la prontitud que se ha convocado al cabildo abierto, no se ha dado tiempo suficiente para que la información llegue a todas las comunidades afectadas, se incorporen otras perspectivas a la discusión y/o el planteamiento de inquietudes sobre el proyecto por parte de la comunidad.

El Observatorio recuerda que el Comité Municipal ha presentado denuncias penales contra el grupo EMCO Holding Inc; por daños al medio ambiente, falsificación de registros, además de denuncias administrativas, las cuales no han sido atendidas por las autoridades competentes. El Observatorio señala que a pesar de la responsabilidad que tiene el Estado hondureño en la implementación de estas medidas, a más de dos meses de que fueron otorgadas al Comité Municipal, las personas beneficiarías señalan que no se ha adoptado ninguna acción de manera consensuada para garantizar su seguridad física e integridad.

Por lo contrario, las autoridades hondureñas al respaldar actos como el cabildo abierto han abonado al contexto de inseguridad en la comunidad, al mismo tiempo que no se han pronunciado o denunciado los actos de estigmatización y amenazas públicas difundidas en medios digitales contra las personas defensoras integrantes del Comité Municipal y beneficiarias de las medidas cautelares.

Finalmente, el Observatorio urge a las autoridades de Honduras a cancelar el proceso de cabildo abierto hasta garantizar la protección de las y los defensores de derechos humanos integrantes del Comité Municipal, y sus familias, y en caso de realizarlo, asegurar que sea una consulta libre, previa e informada y que cuente con la participación de personas expertas independientes que puedan exponer los impactos sanitarios, medioambientales y comunitarios del proyecto.]]></description>
